The problems faced by lawyers will be raised in the Milli Majlis

An online conference of the Parliamentary Committees on Human Rights, Legal Policy and State Building and the Bar Association was held today.

According to the e-huquq.az, Zahid Oruj, the chairman of the parliamentary committee on human rights, Anar Bagirov, chairman of the Bar, a large number of deputies and lawyers attended at the conference. The main topic of discussion was the legislative and other sectoral problems of advocacy in Azerbaijan.

In accordance with the discussion topics proposed at the conference, the problems related to the legislation ensuring the operation of the defense institution (CCC, CCCP, CC, CCp, CAP, CAO, PC, Lawyers and Advocacy, Courts and Judges, Mediation, Enforcement, etc. laws), legal aspects of the organization of free legal aid, tax and social payment obligations of lawyers.

Zahid Oruj, Chairman of the Human Rights Committee, moderated the conference, and after a brief opening speech, Anar Bagirov, Chairman of the Presidium of the Bar Association, made an opening speech and said that the Bar Association, in particular, many measures have been taken to improve the quality of legal assistance provided to citizens by lawyers.

From this point of view, the relevant instructions and recommendations of the Decree and Order signed by the President of the Republic of Azerbaijan, judicial and legal reforms, in particular, the issue of transferring funds to the Bar Association for legal aid at the expense of the state are of special importance. In addition, the amendments to Article #15 of the Law on Lawyers and Advocacy, the Law of the Republic of Azerbaijan on State Forensic Science, and progressive amendments to the procedural legislation serve the purposes of providing quality legal assistance to citizens. Lawyers did not have the right to independently apply to the Center for Forensic Examination for examination, so far. According to the amendments to the legislation, the participants in the trial, lawyers will be able to conclude a contract with the Center of Forensic Examination or an independent expert who will operate in the future, raise relevant issues before the expert, apply for expertise. Thus, lawyers will have ample opportunities to provide quality legal assistance to those who apply to them, to ensure their interests.

However, there are certain problems in terms of the activities of the Bar Association, logistics, as well as the number of lawyers in the regions.

The most crucial issue facing this Conference today should be to discuss and find solutions to the problems faced by lawyers, the contradictions they face, and the obstacles to their advocacy.

In order to continue the measures arising from the implementation of the Decree of the President of the Republic of Azerbaijan dated April 3, 2019 "On deepening reforms in the judicial system" and the humanization of penal policy and decriminalization of crimes, the Presidium established 2 working groups on civil and criminal law. Relevant draft laws and proposals have been prepared and submitted. However, there are still many unresolved issues, and it is possible to come across these cases and problems in the Criminal and Criminal Procedure Legislation.

At the same time, the elimination of non-response to inquiries from lawyers, and, most importantly, criminal liability for issues that hinder advocacy, is currently on the agenda. We must also keep in mind that the high tax burden continues to be a concern for lawyers.

The purpose of discussing them, covering them to the maximum and trying to find a solution is to form a modern justice system in the country that meets international standards and fully embraces public confidence. Therefore, changes to the legislation will led to the satisfaction of all subjects, lawyers and citizens.

Moreover, speeches were made on the basis of the established regulations, to Gudrat Hasanguliyev, Deputy Chairman of the Committee on State Building and Legal Policy of the Milli Majlis, Bahruz Maharramova, a member of the Bar, then elected a deputy of the VI convocation, civil and criminal law officer established by the Presidium. The leaders of the groups were lawyers Mukhtar Mustafayev and Ilhama Hasanova, director of the Legal Aid and Training Center and chairman of the Disciplinary Commission of Advocates Shahmar Mammadova, lawyers A.Mustafayev, A.Alizade, A.Gasimli, J.Aliyeva, E.Usuba, S.Isayeva, F. Shirinova, E. Hasanova and all interested participants were given the speech. Then, the conference continued with discussions and questions of interest to the participants were answered.

It should be noted that in order to ensure the participation of lawyers in the legislative process in the future, they will be invited as independent experts to the working groups established in the committees of the Milli Majlis.

At the end, a transcript of the entire conference was conducted, and all proposals, both oral and written, were collected. Most importantly, the issues raised at the conference and the results of the work to be done will be made public.
