The Supreme Court responded to criticism that it did not initiate legislation

The head of the Supreme Court of the Republic of Azerbaijan Elvin Hatamzadeh commented on the recent statements in some media that the Supreme Court of the Republic of Azerbaijan does not use the right of legislative initiative.

According to the e-huquq.az, E. Hatamzadeh said that the Supreme Court acts directly in the formation of the legislation of the Republic of Azerbaijan in accordance with Article 96 of the Constitution of the Republic of Azerbaijan, using the right of legislative initiative or expressing opinions and proposals in the process of drafting legal acts. He noted that the Supreme Court has prepared and submitted to the Milli Majlis relevant drafts to improve a number of legislative acts, which were adopted by the legislature.

The Head of the Office also noted that the Supreme Court took an active part in the implementation of decree and orders of the President of the Republic of Azerbaijan in the preparation of draft legal acts, expressing opinions and suggestions: “Thus, over the past two years, the Supreme Court has prepared opinions and proposals on more than 300 draft legal acts addressed to the Supreme Court by government bodies and submitted them to the relevant government bodies.”

E. Hatamzadeh also said that in order to ensure the stability of the approach of courts to the solution of legal issues and the predictability of the legal position on the application of normative legal acts, the legislation establishes mechanisms for the Supreme Court to form a unified judicial practice: “In this regard, the decisions of the Supreme Court play an important role in the uniform application of law and the development of legislation."
